Terms and conditions of sale

The terms and conditions of sale reported below apply to both the customer and Alida Ferrini srl, with principal place of business in Florence, Italy, Via Por Santa Maria 60 r (hereinafter AF). All sales of products made via the Site will be on the basis of these Terms of Sale.

Will be considered a customer any natural or juridical person buying AF products through this website.

In the event that one or more of the provisions of these terms and conditions will be found void, voidable, illegal or unenforceable, this will not lead to the ineffectiveness of the entire terms and conditions.

The eventual ineffective provision(s) will be replaced by another(other) standard valid one(s) with regard to the intentions and the contents of the previous void term(s) and in accordance with the italian law and regulations.

These terms and conditions are subject to italian law. Any arising dispute shall be referred to the exclusive jurisdiction of the competent Court of the City of Florence, Italy.

The customer must read these terms and conditions before proceeding with a purchase and for any question is invited to contact AF at info@alidaferrini.com. By using the site and/or placing an order for products from AF, the customer signifies that he is 18 years or older and that he agrees to be bound by these terms and conditions.

Placing and confirming the order

The information about the products and the special offers on this website are not binding for AF and AF has the right to change them anytime.

To place an order, the buyer should select the product, add it to the shopping bag and provide the required information: name, invoice address, shipping address (when different), telephone, email.

The client’s order is an offer to buy a product or products from AF and it will not be deemed to have been accepted by AF until the customer receives a dispatch confirmation email. Once the client receives the confirmation email, a contract is formed between him and AF in relation to the item or items set out in the email and payment will be taken. No product will be shipped until payment has been made in full.

Before items are  dispatched, AF may refuse or accept an order (in whole or in part) as well as any change requested by the customer.

Prices

All prices, payments and invoices are quoted in the Site in Euro.

The effective price of an item is the one indicated at the moment of the order and is inclusive of VAT.

Prices quoted exclude delivery costs. Packaging and transport prices will always be clearly indicated and AF has the right to use any trusted carrier available. It is the buyer’s responsibility to ensure payment of any local tax or duty in force at the time of purchase.

 

Despite AF best efforts, some products may be listed at an incorrect price due to a typographical error or system error. AF reserves the right to review and change product prices on the Site at any time without notice and to refuse or cancel any order placed for items listed at an incorrect price, whether or not the order(s) has(have) been confirmed and the customer card/PayPal/bank account charged. If the client’s card/PayPal account has already been charged or bank transfer done for such a purchase and the order is cancelled, AF will issue a refund to the customer’s card/PayPal/bank account in the amount of the incorrect price.

Payment will be done by customer at the moment of the order, choosing between the options indicated.

Payment

The following methods of payment are accepted by AF:

PayPal

Bank wire transfer

When bank wire transfer is selected as a method of payment, the client will automatically receive an email containing the bank account information of AF. The merchandise will then be reserved until payment has been confirmed. The customer is asked to fax (+39 055 2691103) or email (info@alidaferrini.com) a scanned copy of the bank wire transfer within 48 hours of receiving the email request for payment. If the fax or email of the copy of the transfer is not received within 48 hours, the order will be cancelled.

The merchandise will be shipped once AF has received the payment and the items are ready for shipment.

It is mandatory to specify in the wire transfer the order number and the date of order together with the full name of the buyer.

Credit card

Once a product has been selected, the customer will be asked to communicate all the credit card details trough secure, protected connection. The following cards will be accepted: Visa, Mastercard, American Express, Diners club. The amount of the purchase will be debited to the client when the contract is finalized

on the website.

AF may in its discretion ask the client to send further information or copies of documents to prove  the ownership of the card used to make the purchase. If the customer does not provide such information, AF reserves the right not to accept the conclusion of the contract. During the entire purchase process AF is unable to access personal information about the card holder since this information is directly transmitted to the site of the bank that handles the transaction.

 

PayPal

 

Selecting this method of payment, the client will be redirected to a page of the PayPal site where he can enter his email address and password and proceed with the payment. The customer financial data will not be shared with AF but will be handled directly by PayPal.

 

Shipping

Transport cost

The cost of transportation will be calculated by the system based on the weight of the items ordered and the country of  destination. It will be clearly specified before the payment.

 

Delivery time

The timing of delivery of goods ordered may vary by the kind of items purchased (eg. If the goods are available at the manufacturer). The times given for delivery are indicative and result from this calculation:

Good availability + transport time = Total time of delivery. AF uses couriers /carriers that offer the best service/cost to the destination concerned, most of the time DHL and Bartolini.

 

Important:

AF products are the result of a fine craftsmanship and may not be available at the moment of the order.

In this case, the time of  delivery will be clearly indicated when the client selects the product and he will be able to confirm or cancel the purchase.

 

Goods reception

Upon delivery of the goods, the customer is required to check:

-that the number of packages delivered is as specified in the transport documents

-that the packaging is intact and not altered

In case of tampering and/or breaks, the customer will immediately challenge the shipment by adding the words “GOODS SUBJECT TO CONTROL FOR…” (indicate motivation) on the delivery document received by courier or other operator.

The client must report any damage within 3 days of receipt of goods in the way prescribed by the operator undertaking the expedition.

If the order is returned to AF by carrier because of a wrong address provided by the customer or end of deposit time in the warehouse of the carrier or for any other reason attributable to the negligence of the customer, a new shipment will be possible upon payment of the relative fee after having made arrangements with AF, writing by email to info@alidaferrini.com or by fax to (+39 055 2691103).

Deliveries by appointment and at specific times or days will not be possible in any case.

Return policy

The customer’s return is regulated by law. Returns are possible when the client is an individual who buys goods for purposes not related to his professional activity and the order data do not include a VAT code. The return policy entitles the customer to terminate the contract in the way and with the exceptions listed below.

Terms and conditions of Return 
The return is subject to the following conditions:
-Purchased goods must be undamaged and returned in their original packaging, complete in all their parts (including packaging and any documentation and accessory equipment).
-Shipping will be under the complete responsibility of the customer, until the certificate of receipt reaches AF’s warehouse. AF does not respond in any way for damage or theft/loss of goods returned by unauthorized shipments.  
-The product will have to be returned to AF within 14 days after the order is delivered to the client, along with the authorization form received.

-With the exception of any repair cost for damages assessed to the original packaging, AF will (within 30 days from the return of the goods) refund the customer the entire amount paid by credit card/PayPal or bank wire transfer. In the latter case, the buyer must promptly send AF all his details, including the Iban code.

When the return-policy does not apply

The return policy does not apply when there is lack of the essential integrity of the product (package and / or its contents) and when AF finds:
– Use (even partial) and/or washing of the goods and any supplies.

– Absence of the outer packaging and / or original inner packaging.
– Lack of integral elements of the product, including its accessories.
– Damage of the product occurred after the order was delivered to the client.

CUSTOMERS WHO PURCHASE WITH VAT CAN NOT EXERCISE THE RETURN POLICY

RETURN DO NOT APPLY TO PERSONALIZED GOODS WITH REQUESTED ALTERATIONS OR MADE ON SPECIAL REQUEST OF THE CLIENT.

Major adverse events

AF is not liable for any delay or failure to fulfill any order due to events beyond its control. While every effort will be made to meet clients’ demands, cancellations or variations may occur due to major adverse events such as: war, strike, labour dispute, fire, flood or other causes beyond the control of AF.

Complaints

Complaints will be dealt promptly and in accordance with Italian law. If the customer would like to register a complaint, he should please send an email to: info@alidaferrini.com

Important information

AF has made every effort to display the colors of the products that appear on the website as accurately as possible. However, as computer monitors may vary, AF cannot guarantee that the client monitor’s display of any color will be completely accurate. All items are quality-controlled and checked for any faults before they are dispatched to customers.
